II.1) DESCRIPTION

II.1.4) Short description of the contract or purchase(s): It is
Darlington Borough Council's objective to achieve the best cost-effective
waste management option that more than meets Government targets for
diverting biodegradable waste from landfill and ensures continuity of
waste treatment for the life of the contract. Therefore the authority
wishes to enter into a contract for the receipt, treatment, recycling and
disposal of all its waste that more than meets Government targets for
diverting waste from landfill and ensures continuity of waste treatment
for the life of the contract.
The principal current sources of Darlington’s waste are:
Household waste
General refuse collected from households in black sacks.
Dry recyclables collected from the kerbside in green boxes.
Dry recyclables deposited by residents at 18 ‘bring’ sites, including the
Household Waste Recycling Centre (HWRC) at Whessoe Road.
Green/garden waste deposited by residents at the HWRC for composting.
Bulky items including fridges and freezers collected by the Council or
deposited by residents at the HWRC.
General waste deposited by residents at the HWRC.
Litter and fly tipping
Council operational waste.
Commercial (trade) waste collected from businesses.
This objective therefore requires a solution that diverts sufficient
amounts of biodegradable municipal waste from landfill to meet LATS
targets, at the same time achieving, as a minimum, Darlington’s targets
(to be agreed) for the recycling and/or recovery of municipal waste.
The Procurement is focused on treatment and disposal. However, treatment
and disposal proposals must support waste minimisation, reuse and
recycling to provide a platform for the development of an overall waste
strategy.
The Council wants to retain the option to achieve the most cost-effective
solution in the longer-term as the waste treatment and disposal market
develops more choice and competitiveness in the region, and to be able to
respond to changes in the national policy framework after the end date of
the current regime in 2019/20. Accordingly the Council is looking to let
an 11-year contract for treatment and disposal, to run from April 2009
until March 2020.
It is the Council's intention to procure a semi-integrated waste
management solution (excluding waste collection) It is anticipated that
contractors will put bids in either individually or in partnership with
other suppliers. However if a partnership bid is submitted we would expect
the bid to be led by a lead partner with whom the Council would contract;
all sub-contracting to be managed by the lead contractor.
The service will consist of the following elements (where relevant,
estimated tonnages for each package for 2006/07 are given):
1. Waste Treatment/Landfill
To provide the appropriate technology (MBT, Autoclaving, Energy from Waste
etc) and the landfill element required, including disposal of hazardous
waste, animal carcases and clinical waste (from domestic collections)
(around 48,000 tonnes).
2. Receipt of Recyclable Material
The receipt and responsibility for the processing of recyclates (including
recycling of fridges, freezers and WEEE) (around 7,000 tonnes).
3. Composting
The composting of green waste, either in vessel (enabling food waste to be
included) or windrow (not containing food waste). This may include the
composting of green waste delivered by residents to the Household Waste
Recycling Centre and household collections (should these be instigated) as
well as horticultural green waste (4,500 tonnes).
4. Management of the Household Waste Recycling Centre
To manage the site ensuring the maximum quantity of material is
recycled/reused. To provide for the delivery of WEEE to the site and its
subsequent removal for reprocessing (throughput total 18,000, recycled
tonnage estimate 10,800).

VI.3) PROCEDURES FOR APPEAL:
VI.3.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: Following the evaluation of tenders, Darlington Borough
Council will incorporate a minimum of 10 calendar days standstill period:
this period will commence from the point that the information on the award
of the contract is communicated to all tenderers. This period allows
unsuccessful tenderers to seek further debriefing from the contracting
authority before the contract is entered into. Applicants have 2 working
days from the notification of the award decision to request additional
debriefing and this information has to be provided a minimum of 3 working
days before the expiry of the standstill period. Such additional
information should be required from the person referenced in the above
address (part 1.1). If an appeal regarding the award of a contract has not
been successfully resolved the Public Contracts Regulations 2006 (SI 2006
No 5) / Utilities Contracts Regulations (SI 2005 No 6) (delete as
appropriate) provide for aggrieved parties who have been harmed or are at
risk of harm by a breach of the rules to take action in the High Court
(England, Wales and Northern Ireland). Any such action must be brought
promptly (generally within 3 months). Where a contract has not been
entered into the Court may order the setting aside of the award decision
or order the authority to amend any document and may award damages. If the
contract has been entered into the Court may only award damages.
