II.1) DESCRIPTION

II.1.3) The notice involves: A public contract.
II.1.5) Short description of the contract or purchase(s): Barnsley,
Doncaster and Rotherham Borough Councils, with a combined municipal waste
arising in the order of 450 000 tonnes, are seeking jointly to procure a
contract for the future treatment and disposal of municipal waste that
will divert significant quantities of biodegradable waste from landfill.
This notice is therefore to procure a PFI contract to manage the treatment
and disposal of residual waste from municipal waste and commercial waste
collected by or on behalf of each of the three Councils. The Contractor
may also be required to process municipal waste rejected from HWRC's and
composting initiatives managed by the Councils. It is proposed that the
PFI contract will be let for an indicative period of at least 25 years
from full service commencement.

VI.3) ADDITIONAL INFORMATION: The Authority anticipates an allocation of
PFI credits totalling approx GBP 77.4 million to enable this project to
come to fruition. There will be a Bidders Day held at Magna, Sheffield
Road, Templeborough, Rotherham, S60 1DX, UK on 6th May 2008.
VI.4) PROCEDURES FOR APPEAL
VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: In accordance with Regulation 47 of the Public Contracts
Regulations 2006 the Authorities will incorporate a minimum 10 calendar
day standstill period starting from the date when the award decision
notification is dispatched to bidders. This period allows unsuccessful
bidders to seek further de-briefing from the Authorities before the
contract is entered into. Applicants have until midnight of the second
working day of the standstill period for their additional debriefing
requests to reach the Authorities. A response to such a request must be
provided to the bidder by a minimum of 3 working days before the expiry of
the standstill period. If an appeal regarding the award of the contract
has not been successfully resolved, the Public Contracts Regulations 2006
(SI 2006 No 5) provide for the aggrieved parties who have been harmed, or
at risk of harm as a consequence of the breach of the procurement rules to
bring an action to the High Court. Any such action must be brought
promptly and in any event within 3 months of the date when the grounds of
complaint first arose. Where a contract has not been entered into, the
court may order the setting aside of the award decision or order the
authority to amend any document and may award damages. If the contract has
been entered into, the court may only award damages. The purpose of the
standstill period referred to above is to allow parties to apply to the
court to set aside the award decision before the contract is entered into.
