SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION
II.1.1) Title attributed to the contract by the contracting authority:
M11 Chigwell Logistics Centre.
II.1.2) Type of contract and location of works, place of delivery or of
performance: Services.

II.1.3) The notice involves: A public contract.
II.1.5) Short description of the contract or purchase(s): In order to
control the flow of vehicles into the Olympic Park (OP) construction site,
it is proposed to establish a logistics facility immediately adjacent to
the M11 in the Chigwell area. The M11 Logistics Centre is an off-site
logistics facility that is required on a temporary basis and will be
primarily a lorry holding, security screening and marshalling facility for
the effective, efficient and sustainable transportation of construction
materials, plant and equipment to the Olympic park Construction site.
The proposed M11 Chigwell Logistics Centre site is located immediately
adjacent to the M11 in the Chigwell area; located on the East site of the
M11 accessed by existing slip roads, approximately 4 miles south of the
M25 interchange with the M11 and 1 mile south of junction 5 of the M11.
The main entrance for material deliveries to the OP construction site is
situated some 7.5 miles away following the M11, A406 and A12.
The total area of the proposed M11 Logistics Centre site is approximately
8 acres. It is divided centrally by the M11, with each side being
connected via a road bridge to the north end of the site and a pedestrian
tunnel, which is currently disused, to the centre of the site. The road
bridge has a single lane only as well as a weight restriction, believed to
be in the region of 28 tonnes. On and off slips already exist for both
southbound and northbound carriageways and these are currently signed as a
“Works Unit” from the M11.
The M11 Logistic Centre will have potentially 3 phases:
— Construction Phase (September 2008 – June 2011),
— Games Phase (July 2011 – December 2012),
— Legacy Phase (Optional),
The Contracting Authority is seeking to procure the appointment of works
contractor and a service provider through two lots (Lot 1, Works and Lot
2, Services). Applicants are free to tender for either or both lots.
The Contracting Authority is preparing a design to stage E, securing use
of the site from the Highways Agency and getting planning permission to
build and operate the site. The planning permission will run at least
until 31 December 2012. The Contracting Authority is intending to seek
permissions and rights to operate the site beyond 2012 as a purely
commercial venture and there will be an option under Lot 2 for the
operator to take the site on should the necessary permissions and rights
be secured. Should the rights and permissions not be secured there will be
an option under Lot 1 to reinstate the site in accordance with the
planning conditions.

LOT NO 1
TITLE: Works
1) SHORT DESCRIPTION: The ODA requires a works contractor to build the
M11 Logistic Centre in accordance with the provided design and the
planning conditions. The centre will consist of a lorry security checking,
holding and marshalling area on the East side of the M11 that will be
built. Should the park and ride facility be required that will need to be
built on the West side of the M11. All construction activity should be
completed by Dec 2009.
There will be an option to reinstate the site once the games phase has
completed in Dec 2012.

LOT NO 2
TITLE: Service Provision
1) SHORT DESCRIPTION: The ODA requires a service provider to operate the
logistic centre from Oct 2008 until Dec 2012. This will involve managing
the flow of up to 400 goods vehicles a day through the centre, all of
which will require security checks and logging on the ODA’s Delivery
Management System.
There may be an option to transfer the site to the service provider at the
end of Dec 2012 for ongoing operation as a standalone commercial venture.

SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: The Contracting Authority
reserves the right to require deposits, guarantees, bonds and/or other
forms of approporiate security.

whom the contract is to be awarded: The Contracting Authority reserves the
right to require groupings of contractors to take a particular legal form
or to require a single contractor to take primary liability or to require
that each party undertakes joint and several liability irrespective of the
legal form of the contracting entity. Details will be provided in the
Pre-Qualification Questionnaire and the Invitation to Tender, copies of
which are available from the London 2012 eTendering Service (details of
which can be found at Section IV.3 of this OJEU Notice).

III.2.2) Economic and financial capacity: Information and formalities
necessary for evaluating if requirements are met: Details provided in
Pre-Qualification Questionnaire documentation (see Section VI.3).
Minimum level(s) of standards possibly required: Minimum turnover
requirements for each Lot are:
Lot 1
Applicants will be required to demonstrate a minimum annual turnover in
each of the last 3 consecutive years of GBP £28 000 000 or equivalent in
the reporting currency or equivalent proof of financial standing.
In the case of a consortium bid, the combined minimum annual turnover of
the Applicant and the Relevant Companies in each of the last 3 consecutive
years must be no less than that specified in paragraph above and the
minimum annual turnover of at least one of the parties must be no less
than GBP £7 000 000 or equivalent financial performance in reporting
currency or equivalent proof of financial standing.
Lot 2
Applicants will be required to demonstrate a minimum annual turnover in
each of the last 3 consecutive years of GBP £4 000 000 or equivalent in
the reporting currency or equivalent proof of financial standing.
In the case of a consortium bid, the combined minimum annual turnover of
the Applicant and the Relevant Companies in each of the last 3 consecutive
years must be no less than that specified in paragraph above and the
minimum annual turnover of at least one of the parties must be no less
than GBP £1 000 000 or equivalent financial performance in reporting
currency or equivalent proof of financial standing.
Applicants tendering for either/both Lots will be required at the time of
entering into any contract with the Contracting Authority to possess the
following insurances:
— Employer's liability insurance compliant with the amount required by the
applicable law. This insurance should include an Indemnity to Principle
clause and Waiver of Subrogation in favour of the Contracting Authority
and Delivery Partner and LOCOG,
— Professional indemnity insurance for all activities of a professional
nature, and including design liability of building contractors, with a
limit of indemnity of not less than £5 000 000 annually maintained for a
period of 12 years following completion of the whole of the works, save
that aggregate limits (not necessarily equal to the per claim limit
mentioned above) may be acceptable in relation to contamination and/or
pollution claims,
— Loss of or damage to Equipment with the replacement cost as minimum
amount of cover,
— Loss of or damage to Plant and Materials during storage, off site
prefabrication and transit from place of manufacture outside the UK to the
Site with the replacement cost as minimum amount of cover,
— Liability for death or bodily injury to employees of the Contractor
arising out of and in the course of their employment in connection with
this Contract. The amount required by the applicable law. This insurance
should include an Indemnity to Principal clause and Waiver of Subrogation
in favour of the Contracting Authority, Delivery Partner and LOCOG,
— Motor Third Party Liability Insurance. Minimum amount of cover in
respect of all vehicles used on public highways, site access roads or in
any circumstances requiring insurance under the Road Traffic Acts,
— Other insurances required by statute.
III.2.3) Technical capacity: Information and formalities necessary for
evaluating if requirements are met: Details provided in Pre-Qualification
Questionnaire documentation (see Section VI.3).
Minimum level(s) of standards possibly required: 1) Applicants must be
able to undertake all elements of the scope for the Lot(s) they are
interested in tendering for.
2) Provide 2 recent case studies per Lot that demonstrates the Applicant's
ability to successfully deliver each of the lots applied for that respond
to criteria in the PQQ.
3) Confirm that the Applicant has a health and safety policy that meets
the minimum standard set out in the PQQ.
4) Applicants will be required to demonstrate that they will be able to
comply with the minimum requirements set out in the ODA Policies and
Strategies as set out in the PQQ in respect of the Applicant's capability
to deliver the Contracting Authority's requirements.

into by or on behalf of any one or more of these bodies, together with any
of their statutory successors and/or organisations created as a result of
reorganisation or organisational changes.

It is the Olympic Delivery Authority’s intention to administer all
procurement opportunities through the London 2012 e-Tendering Service. As
part of the registration process you will be asked to read and confirm
your understanding, and acceptance of the terms and conditions governing
use of the London 2012 e-Tendering Service (“User Agreement”). A
fundamental aspect of the User Agreement is your acceptance of the
confidentiality, no marketing rights and restrictions on publicity which
are specifically designed to protect the Olympic related rights of the

VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: The ODA will incorporate a minimum of 10 calendar day
standstill period at the point information on the award of the contract is
communicated to bidders. This period allows unsuccessful bidders to seek
further debriefing from the Contracting Authority before the contract is
entered into. Candidates have two working days from the notification of
the award decision to request additional debriefing and that information
has to be provided a minimum of three working days before the expiry of
the standstill period. Such additional information should be required from
the addressee in Section I.1.
If an appeal regarding the award of the contract has not been successfully
resolved, the Public Contracts Regulations 2006 (SI 2006 No.5) provide for
aggrieved parties who have been harmed or are at risk of harm by a breach
of the rules to take action in the High Court (England, Wales and Northern
Ireland). Any such action must be brought promptly (generally within 3
months). Where a contract has not been entered into, the Court may order
the setting aside of the award decision or order the authority to amend
any document and may award damages. If the contract has been entered into
the Court may only award damages. The purpose of the standstill period
referred to above is to allow parties to apply to the Courts to set aside
the award decision before the contract is entered into.
