CONTRACT SPECIFICATIONS
6. Description of the contract The Contract involves the design,
construction and operation for a limited period of two large WWTP, Al
Kissweh Wastewater Treatment Plant (190,000 pe) and Jdeidat Artouz
Wastewater Treatment Plant (170,000 pe), and two smaller plants, Kanaker
WWTP (28,000 pe) and Khiaret Dannoun WWTP (10,000 pe). The plants are
located to the southwest of Damascus in Syria. They are part of a large
programme to improve the water supply and waste water treatment in Rural
Damascus.
The contracts will be implemented using the FIDIC 1999 Conditions of
Contract for Works Designed by the Contractor (Yellow Book). The
Contractor will be required to operate the plants for two years during the
Defects Notification Period and the Employer will have the option to
extend this operation period for a further five years.
7. Number and titles of lots For the construction, the plants will be
split into three lots, namely:
Lot 1 Design, build and limited operation (two years) of Al Kissweh
Wastewater Treatment Plant (190,000 pe)
Lot 2 Design, build and limited operation (two years) of Jdeidat Artouz
Wastewater Treatment Plant (170,000 pe)
Lot 3 Design, build and limited operation (two years) of Kanaker WWTP
(28,000 pe) and Khiaret Dannoun WWTP (10,000 pe)
TERMS OF PARTICIPATION
8. Eligibility and rules of origin Participation is open on equal terms
to all natural and legal persons [participating either individually or in
a grouping (consortium) of tenderers] of the eligible countries as defined
by Article 11 of Law 51/2004 of the Syrian Arab Republic and the
regulations of the EIB. All goods supplied under this contract must
originate in these countries.
9. Grounds for exclusion Applicants must furnish proof that they are not
in any of the situations listed in point 2.3.3 of the 'Practical guide to
contract procedures financed by the general budget of the European
Communities in the context of external actions'.
10. Number of applications Applicants (including firms within the same
legal group, other members of the same consortium, and sub-contractors)
may submit only one application for one or more lots. Applications for
parts of a lot will not be considered.
11. Shortlist alliances prohibited Any tenders received from tenderers
comprising firms other than those mentioned in the short-listed
applications will be excluded from this restricted tender procedure.
Short-listed candidates may not form alliances or subcontract to each
other for the contract in question.
12. Period of execution The time for completion of the works shall be of
730 days from the Commencement Date, for each of the three lots.
PRE-QUALIFICATION CRITERIA
13. Pre-qualification criteria The lots being tendered are categorised as
follows:
- Group A: Lots 1, 2;
- Group B: Lot 3;
For one lot of Group A and the lot in Group B, the Applicant shall meet
the following minimum criteria:
1. Construction Experience:
a. Minimum annual turnover in construction of water or wastewater
treatment plants over the last 3 years:
- For one lot of Group A: 50 million EURO equivalent;
- For the lot in Group B: 25 million EURO equivalent.
b. Work experience in terms of number of similar projects:
NOTE: Work experience in terms of similar projects to the proposed
contract shall be interpreted as follows:
- Similar nature means projects consisting of the design and execution of
wastewater treatment plants;
- The minimum size (value) that will be taken into consideration is either
the total project value, when the contractor was acting as sole
contractor, or the share of the total project value corresponding to its
share of the joint-venture participation, when the contractor was member
of a joint-venture. The project value corresponds to the value of the
works, regardless of any financing costs or other similar costs.
- The last 5 years shall be understood as the period: 1st of January 2003
– 30th of June 2008.
For one lot of Group A:
Successful experience as main contractor in the execution of at least one
similar project with the value of minimum 10 million Euro equivalent,
completed within the last five years, and of 3 projects with a value of
minimum 7.5 million Euro equivalent each, one of them being completed
within the last five years. The other 2 projects may be under execution.
All the four projects must be of nature similar to the proposed contract.
For the lot in Group B:
Successful experience as main contractor in the execution of at least one
similar project with the value of minimum 5 million Euro equivalent,
completed within the last five years, and of 3 projects with a value of
minimum 3.5 million Euro equivalent each, one of them being completed
within the last five years. The other 2 projects may be under execution.
All the four projects must be of nature and complexity comparable to the
proposed contract.
2. Design Experience (either in his own right or by his proposed design
subcontractor):
a. Minimum annual turnover in design of water or wastewater treatment
plants over the last 3 years:
- For one lot of Group A: 3 million EURO equivalent;
- For the lot in Group B: 1.5 million EURO equivalent.
b. Work experience in terms of number of similar projects:
NOTE: Work experience in terms of similar projects to the proposed
contract shall be interpreted as follows:
- Similar nature means projects consisting of the design of wastewater
treatment plants;
- The minimum size (value) that will be taken into consideration is either
the total project value, when the contractor was acting as sole designer,
or the share of the total project value corresponding to its share of the
joint-venture participation, when the contractor was member of a
joint-venture. The project value corresponds to the value of the works,
regardless of any financing costs or other similar costs.
- The last 5 years shall be understood as the period: 1st of January 2003
– 30th of June 2008.
For one lot of Group A:

minimum construction value of 3.5 million Euro equivalent each, one of
them being completed within the last five years. The other 2 projects may
be under execution. All the four projects must be of nature and complexity
comparable to the proposed contract.
3. Financial Standing
a. Financial Resources
The Applicant shall demonstrate, by a bank statement from his bank, that
he has available or he has access to, liquid assets, lines of credit, or
other financial means sufficient to meet the construction cash flow:
- not less than 3 million EURO equivalent, for one lot of Group A,
- not less than 1 million EURO equivalent, for the lot in Group B,
apart from the applicant's commitments to other contracts.
a. Financial Position
The audited financial statements for the last 3 years as well as
documented cashflow projections for the next 2 years shall be submitted
and must demonstrate the soundness of the applicant's financial position,
showing long-term profitability.
N.B. The Contracting Authority reserves the right to carry out such
further inquiry on the applicant's financial standing, as the Evaluation
Committee may deem appropriate.
4. Litigation History
The applicant shall provide accurate information on any current or past
litigation or arbitration resulting from contracts completed, terminated,
or under execution by him over the last five years. A consistent history
of awards against the Applicant may lead to the rejection of the
application.
5. Joint Ventures/ Consortia
Joint Ventures/Consortia shall meet the following particular qualification
criteria:
For one lot of Group A:
a. The leading partner shall meet no less than 50% of the general
experience and financial resources criteria specified above.
It means that the leader shall demonstrate:
- a minimum annual turnover in the water sector over the last 3 years of
25 million EURO equivalent, and
- successful experience as main contractor in the execution of at least
one similar project with the value of minimum 7.5 Meuro equivalent,
completed within the last five years, and of 3 projects with a value of
minimum 5 Meuro equivalent each, one of them being completed within the
last five years. The other 2 projects may be still under execution. All
four projects must be of nature and complexity comparable to the proposed
contract.
As financial resources, the leader must demonstrate, by a bank statement
from his bank, that he has available or he has access to, liquid assets,
lines of credit, or other financial means sufficient to meet part of the
construction cash flow for the contract, for a period of 6 months, not
less than 1.5 Meuro, apart from its commitments for other contracts.
a. Each other partner shall meet no less than 10% of the general
experience and financial resources criteria specified above.
It means that each other partner shall demonstrate:
- a minimum annual turnover in the water sector over the last 3 years of 5
million EURO equivalent, and
- successful experience as main contractor in the execution of at least
one similar project with the value of minimum 2 Meuro equivalent,
completed within the last five years, and of 3 projects with a value of
minimum 1 Meuro equivalent each, one of them being completed within the
last five years. The other 2 projects may be still under execution. All
four projects must be of nature and complexity comparable to the proposed
contract.
As financial resources, each partner must demonstrate, by a bank statement
from his bank, that he has available or he has access to, liquid assets,
lines of credit, or other financial means sufficient to meet part of the
construction cash flow for the contract, for a period of 6 months, not
less than 0.5 Meuro, apart from its commitments for other contracts.
a. The Joint Venture/Consortium must satisfy collectively the general
experience and financial resources criteria stated above.
It means that the Joint Venture, as a whole, shall demonstrate:
- a minimum annual turnover in the water sector over the last 3 years of
50 million EURO equivalent, and
- successful experience as main contractor in the execution of similar
projects with a total cumulated value of minimum 34 Meuro equivalent (each
individual project having a minimum value of 1 Meuro equivalent). The
projects must be of nature and complexity comparable to the proposed
contract.
As financial resources, the Joint Venture must demonstrate, by the bank
statements provided by its members, that he has available or he has access
to, liquid assets, lines of credit, or other financial means sufficient to
meet the construction cash flow for the contract, for a period of 6
months, not less than 3 Meuro, apart from commitments of the J.V. partners
for other contracts.
Each individual member shall satisfy the sound financial position and
litigation history criteria.
For the lot in Group B:
a. The leading partner shall meet no less than 50% of the general
experience and financial resources criteria specified above.
It means that the leader shall demonstrate:
- a minimum annual turnover in the water sector over the last 3 years of
13 million EURO equivalent, and
- successful experience as main contractor in the execution of at least
one similar project with the value of minimum 2.5 Meuro equivalent,
completed within the last five years, and of 3 projects with a value of
minimum 2 Meuro equivalent each, one of them being completed within the
last five years. The other 2 projects may be under execution. All four
projects must be of nature and complexity comparable to the proposed
contract.
As financial resources, the leader must demonstrate, by a bank statement
from his bank, that he has available or he has access to, liquid assets,
lines of credit, or other financial means sufficient to meet part of the
construction cash flow for the contract, for a period of 6 months, not
less than 1 Meuro, apart from its commitments for other contracts.
a. Each other partner shall meet no less than 10% of the general
experience and financial resources criteria specified above.
It means that each other partner shall demonstrate:
- a minimum annual turnover in the water sector over the last 3 years of 3
million EURO equivalent, and
- successful experience as main contractor in the execution of at least
one similar project with the value of minimum 0.5 Meuro equivalent,
completed within the last five years, and of 3 projects with a value of
minimum 0.35 Meuro equivalent each, one of them being completed within the
last five years. The other 2 projects may be under execution. All four
projects must be of nature and complexity comparable to the proposed
contract.
As financial resources, each partner must demonstrate, by a bank statement
from his bank, that he has available or he has access to, liquid assets,
lines of credit, or other financial means sufficient to meet part of the
construction cash flow for the contract, for a period of 6 months, not
less than 0.1 Meuro, apart from its commitments for other contracts.
a. The Joint Venture/Consortium must satisfy collectively the general
experience and financial resources criteria stated above.
It means that the Joint Venture, as a whole, shall demonstrate:
- a minimum annual turnover in the water works sector over the last 3
years of 25 million EURO equivalent, and
- successful experience as main contractor in the execution of similar
projects with a total cumulated value of minimum 15 Meuro equivalent (each
individual project having a minimum value of 0.35 Meuro equivalent). The
projects must be of nature and complexity comparable to the proposed
contract.
As financial resources, the Joint Venture must demonstrate, by the bank
statements provided by its members, that he has available or he has access
to, liquid assets, lines of credit, or other financial means sufficient to
meet the construction cash flow for the contract, for a period of 6
months, not less than 1 Meuro, apart from commitments of the J.V. partners
for other contracts.
Each individual member shall satisfy the sound financial position and
litigation history criteria.
6. Designated sub-contractors (for more than 10% of the Contract value)
shall:
- meet the general experience criteria set above in the same proportion as
the envisaged part of the sub-contractor in the Contract value (the
sub-contractors shall meet the sub-criteria according to the nature of
their involvement in the contract);
- meet the sound financial position and litigation history criteria.
7. Application submitted for more than one lot
The qualification requirements shall be first checked lot by lot and then
for combinations of lots.
The qualification requirements for combination of lots are thoroughly
detailed in the Prequalification Dossier. The basic principle is the
following:
- for combination of two lots, the qualification criteria are calculated
as 80% of the sum of the thresholds established for the respective two
lots;
- for combination of three lots, the qualification criteria are calculated
as 70% of the sum of the thresholds established for the respective lots.
14. Pre-qualification The short-list of pre-qualified applicants shall be
published on the European Commission web site and on the MoHC web site. At
the same time, a separate letter shall be transmitted to each of the
applicants informing them with regard to the result of the
prequalification exercise.
An applicant prequalified for a type of lot or a combination of lots of
Type A and/ or Type B shall be allowed to further tender for any lot and
combination, but will not be awarded more than the configuration for which
it has been prequalified.
