SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION

II.1.5) Short description of the contract or purchase(s): The Council is
seeking to enter into a long term PFI/PPP contract with one contractor (or
consortium) for the design, build, financing and operating of a main waste
treatment facility (or facilities) for the processing and disposal of its
residual (black bag) municipal waste that is currently consigned to
landfill.

II.2) QUANTITY OR SCOPE OF THE CONTRACT
II.2.1) Total quantity or scope: The Council intends to procure the
service in accordance with the UK Government’s Private Finance Initiative
(PFI) and envisages a contract period of approximately 27 years although
the contract period will be determined by best value considerations during
the Competitive Dialogue process. The procurement is for the DBFO of a
main treatment facility (or facilities) and directly associated services
such as the provision of landfill for residues to the extent necessary,
haulage of residues from the facility (or facilities) to a final disposal
site, the securing of off take for residues, recyclates and energy (as
relevant) and the provision of information and visitor facilities. The
procurement is not intended to include any of the collection or delivery
functions to the facility (or facilities). However, as a matter of
flexibility the Council may wish to include some ancillary waste
management services such as (but not limited to) transfer stations and
bulking and haulage operations. These ancillary services shall be included
at the Council's discretion as anticipated changes and the Bidders'
willingness or capacity to provide them, while being explored during the
Competitive Dialogue, will not be a key part of the Council's evaluation.
As the Council is a large consumer of energy for its schools, offices,
street lighting etc, as part of the competitive dialogue procedure the
Council may also wish to explore with those Bidders proposing high energy
output technologies whether there is any mutual benefit in contracting to
purchase some or all of the energy produced from the Main Treatment
Facility(ies). Accordingly the scope of the contract may include the
supply of energy to the Council. The key driver for the Council is to
secure diversion of municipal waste from landfill and the diversion of BMW
to achieve its LATS targets. Total municipal waste arisings in Suffolk in
2006/7 was 421 000 tonnes of which 171 000 tonnes was recycled or
composted and 250 000 tonnes consigned to landfill. By way of guidance but
without warranty, current projections (allowing for growth, waste
minimisation and improved recycling) are that approximately 250 000 tonnes
per annum of residual municipal waste will need to be treated in the
future.
II.3) DURATION OF THE CONTRACT OR TIME-LIMIT FOR COMPLETION: Duration in
months: 324 (from the award of the contract).
SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: The Council reserves the right
to require deposits, guarantees, bonds or other forms of appropriate
security.
III.1.2) Main financing conditions and payment arrangements and/or
reference to the relevant provisions regulating them: Unitary charge with
performance and availability adjustments. Payment mechanism will be
developed as part of the Competitive Dialogue process.
III.1.3) Legal form to be taken by the group of economic operators to
whom the contract is to be awarded: The Council will accept bids from
companies or from consortia / joint ventures provided they form legal
entities prior to award. Participants must provide full details of their
proposed contracting structures.

SECTION VI: COMPLEMENTARY INFORMATION
VI.1) THIS IS A RECURRENT PROCUREMENT: No.
VI.2) CONTRACT RELATED TO A PROJECT AND/OR PROGRAMME FINANCED BY EU
FUNDS: No.
VI.3) ADDITIONAL INFORMATION: All interested organisations are required
to complete and return a pre-qualification questionnaire (PQQ). The PQQ is
available from the contact point given in I.1 above. Only those
organisations returning the PQQ will be deemed to have made an expression
of interest. A Bidders Conference will be held during the PQQ process
details of which will be included in the PQQ. Whilst the Council’s Outline
Business Case demonstrates a single Energy from Waste (EfW) facility to be
affordable and deliverable, the Council is not prescribing any specific
waste treatment technology. The Council intends to make a site available
to Bidders subject to its suitability although Bidders may, if they
prefer, put forward their own site(s). Organisations wishing to be
considered must be able to demonstrate experience of similar projects and
a capability to provide a solution that meets the Council’s output-based
specification. The services to be procured is/are intended for the
Council’s residual waste needs. However if the nature of the solutions put
forward have early years or low growth capacity, such spare capacity may
be made available to neighbouring waste disposal authorities (by way of
one of a variety of contractual arrangements including by way of a
Framework). To that extent those waste disposal authorities would also be
Contracting Authorities for the purposes of this Contract Notice. This is
not intended to increase the overall scope or size of the service
necessary to meet the Council's needs. As with other UK authorities,
Suffolk and Norfolk are currently the subject of local government
structural review by the Boundary Committee. Further details about the
structural review will be given in the Council's Initial Descriptive
Document (to be included in the Information Pack to be made available with
the PQQ to interested organisations). In the mean time and subject to the
outcome of this review Bidders should be aware that one or more new
unitary authorities may be created with disposal authority functions. In
such circumstances, this notice shall stand as a Contract Notice issued on
behalf of Suffolk County Council and (if relevant and subject to the
wishes of the new unitaries or any of them) any or all Waste Disposal
Authorities (WDAs) created as a result of the structural review within or
crossing the current Suffolk administrative border and all reference to
the "Council" shall be construed accordingly. The nature of any
arrangements will be explored in the early stages of the Competitive
Dialogue together with the most suitable form of legal arrangement between
Suffolk and any new WDAs such as one of the new Suffolk authorities acting
as a central purchasing authority.
VI.4) PROCEDURES FOR APPEAL
VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: The Council incorporates a minimum 10 calendar day
standstill period at the point information on the award of contract is
communicated to tenderers. This period allows unsuccessful tenderers to
seek further debriefing from the contracting authority before the contract
is entered into. Applicants have 2 working days from the notification of
the award decision to request additional debriefing and that information
has to be provided a minimum of 3 working days before the expiry of the
standstill period. Such additional information should be requested from
the address in Section 1 of this Notice. If an appeal regarding the award
of contract has not been successfully resolved; the Public Contracts
Regulations 2006 (SI 2006 No 5), provide for aggrieved parties who have
been harmed or are at risk of harm by a breach of the rules, to take
action in the High Court (England, Wales and Northern Ireland). Any such
action must be brought promptly (generally within 3 months). Where a
contract has not been entered into the court may order the setting aside
of the award decision or order the authority to amend any document and may
award damages. If the contract has been entered into the Court may only
award damages.
