II.1.4) Short description of the contract or purchase(s): The Council's aim is to secure a fully integrated service that will fulfil the Council's statutory waste functions. West Berkshire District Council is seeking a service provider to deliver all resources, including facilities, infrastructure and services necessary to collect, recycle, compost, treat and dispose of all its municipal waste. This is likely to include the development of the concept of an Ecology Village/Resource Park. The Contractor will also be required to develop waste education programmes. The Council recognises that there are a number of possible solutions to achieve the Council's objectives and is looking to the Contractor to propose innovative solutions to meet its requirements. Providers may be able to fulfil their obligations by use of sites outside of the West Berkshire area. The Council reserves the right to enter into an agreement with the preferred bidder/appointed contractor to commence provision of the kerbside recycling service prior to commencement of the full PFI. SECTION VI: COMPLEMENTARY INFORMATION VI.2) ADDITIONAL INFORMATION: II.1.9) It is the Council's intention to award the entire contract to a single trading entity. However, the Council reserves the right to award the contract in whole or in part and reserves the right to award elements separately. The Council reserves the right in particular to let the provision of disposal and/or treatment separately and the kerbside recycling service early (see II.1.6). II.1.10) Variants will be accepted in addition to a compliant bid and in accordance with the terms of the ITN. The Council must be satisfied that a variant bid will satisfy the core requirements. II.3) The duration of the contract is expected to be in the region of 25 years. However, an alternative time period may be negotiated if beneficial. VI.3) PROCEDURES FOR APPEAL: VI.3.2) Lodging of appeals: Precise information on deadline(s) for lodging appeals: In accordance with Regulation 32 of the Public Contracts Regulations 2006 West Berkshire Council will incorporate a minimum 10-calendar-day standstill period at the point information on award of the contract is communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the contracting authority before the contract is entered into. Applicants have 2 working days from the notification of the award decision to request additional debriefing and that information has to be provided a minimum of 3 working days before the expiry of the standstill period. If an appeal regarding the award of a contract has not been successfully resolved the Public Contracts Regulations 2006 (SI 2006 No 5)provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court(England, Wales or Northern Ireland). Any such action must be brought promptly(generally within 3 months). Where a contract has not been entered into, the Court may order the setting aside of the award decision or order the authority to amend any document and may award damages. (The purpose of the standstill period referred to above is to allow parties to apply to the Courts to set aside the award decision before the contract is entered into).
