SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION
II.1.1) Title attributed to the contract by the contracting authority:
Mandate Agreement for Project Implementation: Access to Justice and
Judicial Reform in Tajikistan.

II.1.5) Short description of the contract or purchase(s): Introductory
remarks: Since 2001 this project was self implemented by SDC (with local
partner organizations). Now SDC has taken the decision to outsource the
project implementation to an external agency. (The project history is well
reflected in the Project Document.) However, the broad direction of the
project should remain unchanged. For the elaboration of the tenders, the
most relevant document is the Project Document.
The main strategy of the project is to support the development of a
transparent, effective justice system capable to protect people’s rights,
accessible for people, particularly poor and marginalized men and women,
especially in the rural areas. The project aims at an improvement of
judicial capacities to consider cases based on the rule of law, in the
availability of adequate legal services to the population and increasing
the professionalism of lawyers in defending Human Rights.
The project objectives will be focused on the same legal spheres as in
previous phases with the necessary adaptation to the new situation,
recommendations and lessons learned.
The overall goal is to contribute to increased respect and protection of
the rights of poor and marginalised on the grounds of gender, ethnicity
age or other prejudice in Tajikistan by strengthening the rule of law,
access to justice and improvement of justice administration mechanisms.
During the next phase of the project the implementing agency will have to
maintain the essential activities undertaken by the project in the past
while at the same time developing the macro elements including new
initiatives in judicial reform, advocacy and human rights promotion. A
particularly critical development is the support of new pilot project
which integrates human rights protection into the development process in a
new locality. Proper baseline study should be conducted prior to the
opening of the new legal aid centre in order to assess overall legal and
social situation in particular region. The Swiss Cooperation Office in
Tajikistan/Dushanbe (SCO) will continue to maintain and develop the
relationship with the national government while at the same time
contributing to process of legislative and policy changes. The SCO will
provide necessary assistance to the implementing agency in elaboration and
promotion of the new ideas in judicial and legal reform spheres.
The following task division is proposed between the SCO and the
Implementing Agency: SCO responsibility: Consideration of support to the
most important judicial reform ideas.
- (conducted through Judicial reform coordination council); Policy
dialogue with Judicial Training Center (JTC) and Council of Justice on
further development of SCO support towards judiciary; Dialogue and
consideration of support to the Government on various Human Rights issues;
Development of the process of legal profession reform in Tajikistan;
- (including: negotiations with the Ministry of Justice, Bar Associations
and other donors); Identification of the possible projects and allocation
of the funds; Monitoring and evaluation of activities of the Implementing
Agency.
Implementing Agency's responsibilities: Management of the legal aid
centers (monitoring of activities, report analysis, funds disbursements);
Capacity building of the partner NGOs.

- (management of funds); Management of funds in the Human Rights Treaty
network; Capacity building;
- training of HR partners; Elaboration and implementation of mass media
actions; Maintaining of the case recording system;
