SECTION II: OBJECT OF THE CONTRACT
II.1) DESCRIPTION

II.1.5) Short description of the contract or purchase(s): The provision
of efficient, effective, integrated and innovative pension fund
administration services to the Environment Agency for its two Local
Government Pension Scheme (LGPS) pension funds with approximately 44 000
members. The services to be provided include the supply of integrated
pension fund administration services including membership records
administration, membership communications, pension fund website, pensioner
payroll, pension fund banking, accounting and reporting, technical advice
and consultancy, pension committee trustee reporting, and other associated
ancillary administration services.

II.2) QUANTITY OR SCOPE OF THE CONTRACT
II.2.1) Total quantity or scope: The Environment Agency requires a third
party administrator to provide fully integrated, innovative, and
cost-effective outsourced pension fund administration services for its two
LGPS pension funds. You will be required to deliver the required services
detailed below for 44 000 fund members, comprising 12 000 active
contributing members, 10 000 deferred members, and 22 000 pensioners. The
services required include responding to pension fund membership enquiries,
maintenance of all pension funds membership records, providing fund
membership communications, developing and maintaining the pension fund
website, provision of LGPS and wider pensions technical advice and
consultancy services, collecting fund contributions, fund banking,
provision of management and financial accounting services, preparation of
statutory annual reports and audited statements, undertaking all HMRC
requirements, provision of monthly pensioner payroll, carrying out
anti-fraud prevention measures, recovery of overpayments, monthly and
quarterly performance reporting to contract manager and pensions
committee, provision of secretariat services for client meetings and
pension committee trustee meetings, and other associated ancillary and ad
hoc pension fund administration services. The services do not include
pension fund investment in financial markets. Suppliers will be required
to deliver all or the majority of the required services. The Agency may
require some services to be delivered to different extents dependant on
its business and fund member needs. Additional details will be provided in
the Invitation to Tender.
Estimated value excluding VAT:
Range: between 5 000 000 and 10 000 000 GBP.
II.2.2) Options: Yes.
Description of these options: The successful tenderer will go live with
services from 1.10.2009 following a 6 month period of handover from the
current provider. The contract will be awarded for a period of 5 years.
There will be an option for an extension to the contract for up to a
further 5 years, subject to satisfactory performance in the first 5 years.
Provisional timetable for recourse to these options: in months: 60 (from
the award of the contract)
Number of possible renewals: Range: between 1 and 4.
II.3) DURATION OF THE CONTRACT OR TIME-LIMIT FOR COMPLETION: Duration in
months: 120 (from the award of the contract).

III.1) CONDITIONS RELATING TO THE CONTRACT

following information is provided in the order stated below and is clearly

Submission of the firms balance sheets or extracts there from, where
publication of a balance sheet is required under company law in the
country in which the supplier is established.

statement of the firms overall turnover and its turnover in respect of the
services to which the contract relates for the previous 3 financial years.
Evidence of the financial status of the firm from a recognised credit
rating agency with ratings for last 3 years.
Evidence of professional indemnity insurance including level of cover.
Evidence of public liability insurance and level of cover.
Evidence of any other relevant insurance and level of cover.
III.2.3) Technical capacity: Information and formalities necessary for
evaluating if requirements are met: Your response should be returned

Brief description of the primary business of the company and relevant
pension fund administration experience.
Evidence of Financial Services Authority registration and or other
relevant or equivalent regulatory body licences you hold in order to
operate your business.
Details of any court cases or tribunals in connection with
maladministration or grievances, and past, present or pending
investigations by the industry regulator into your organisation or any of
its officers or directors related to the operation of your organisation
over the last 5 years.
Demonstrate and evidence that you have suitable experience of managing
similar outsourced pension fund administration services to other large
public or private sector pension funds and organisations in the last 5
years, and the number of your staff engaged in the services to which these
contracts relate, showing full time managerial, technical and
administrative staff separately.
Demonstrate and evidence you have systems and processes for ensuring
quality control with respect to your pension administration services,
information technology, data protection and security, disaster recovery
and business continuity together with any relevant certificates and
assurance reports such as ISO9000 or equivalent quality management system
standard, AAF 01/06 on internal controls or equivalent, BIP 0008 Code of
Practice on Legal Admissibility of Electronic Documents or an equivalent
standard, and any other industry recognised or equivalent standards.
Names of other at least 3 other public sector pension funds with over 25
000 members from whom we can source reference reports.

The Environment Agency reserves the right not to proceed with the
procurement process at any time during the process, which shall include
the right not to award the contract and does not bind itself to accept the
lowest tender, or any tender received, and reserves the right to award the
contract in part, or to call for new tenders should it consider this
necessary.
The Environment Agency shall not be liable for any costs or expenses
incurred in connection with the completion and return of the information
requested in this Contract Notice.
An organisation can be excluded from this procurement process if it is
guilty of serious misrepresentation in supplying or failing to supply the
information required by the Environment Agency under the Public Contracts
Regulations 2006 or if it may be considered to be ineligible to tender by
reason of one of the circumstances set out in Regulation 23 of the Public
Contracts Regulations 2006. Please provide a signed Declaration that you
have read Regulation 23 of the Public Contracts Regulations 2006 and that
none of the circumstances apply to your organisation or to any one of the
directors within your organisation.
Failure to return all requested information together with the Declaration
referred to above by the specified date may result in exclusion from the
procurement proce.

VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: The Environment Agency will incorporate a minimum 10
calendar day standstill period at the point information on the award of
the contract is communicated to tenderers. This period allows unsuccessful
tenderers to seek further debriefing from the contracting authority before
the contract is entered into. Applicants have 2 working days from
notification of the award decision to request additional debriefing and
that information has to be provided a minimum of 3 working days before
expiry of the standstill period. Such additional information should be
requested from the address in section 1.1.
If an appeal regarding the award of a contract has not been successfully
resolved the Public Contracts Regulations 2006 (SI 2006 No 5) provide for
aggrieved parties who have been harmed or are at risk of harm by a breach
of the rules to take action in the High Court (England, Wales and Northern
Ireland). Any such action must be brought promptly (generally within 3
months). Where a contract has not been entered into the court may order
the settling aside of the award decision or order the authority to amend
any document and may award damages. If the contract has been entered into
the court may only award damages.
