II.1) DESCRIPTION

II.1.5) Short description of the contract or purchase(s): Thames Water
has a continued commitment to sustainability. The Beckton biodiesel plant
is designed to provide a sustainable energy solution. This OJEU notice
supports this requirement.
Thames Water has a requirement for 15 000 000 litres of B100 biodiesel
fuel per annum to power its 8MWe Biodiesel CHP plant located at Beckton
Sewage Treatment work, Essex, UK. Thames Water may purchase the following
categories of product, the total of these volumes totalling approximately
15,000,000 litres per year.
Fuel Type A - EN14214 and Caterpillar fuel specifications combined (with
max equivCO2 factor & no CFPP specified).
Fuel Type B - Caterpillar fuel specification (with max equivCO2 factor &
no CFPP specified).
The supplier will be required to propose the feedstock blend that will
provide Thames Water with the most optimum product in terms of gCO2/MJ and
price.
Note also that following award of framework agreement(s), Thames Water may
wish to carry out research with selected supplier(s) to develop further
variants of biodiesel fuel to suit the specific requirements of the
engines installed at Beckton in order to achieve maximum efficiency for
the plant.

II.2) QUANTITY OR SCOPE OF THE CONTRACT
II.2.1) Total quantity or scope: Information to be provided in the

Description of these options: Any agreement awarded would be for an
initial duration of 2 years with options to extend annually up to a
maximum overall term of 5 years. This would be subject to satisfactory
reviews on price and supplier performance. The length of the agreement
maybe subject to change if unforseen changes to the business occur.
Number of possible renewals:Nil.
II.3) DURATION OF THE CONTRACT OR TIME LIMIT FOR COMPLETION: Duration in
months: 60 (from the award of the contract).
SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: N/A.
III.1.2) Main financing conditions and payment arrangements and/or
reference to the relevant provisions regulating them: Specified in enquiry
document.
III.1.3) Legal form to be taken by the grouping of economic operators to
whom the contract is to be awarded: Consortia may be required to form a
legal entity prior to any award.
III.1.4) Other particular conditions to which the performance of the
contract is subject: No.
III.2) CONDITIONS FOR PARTICIPATION
III.2.1) Personal situation of economic operators, including requirements
relating to enrolment on professional or trade registers: Information and
formalities necessary for evaluating if requirements are met: Minimum data
is to be provided at this pre-qualification stage. As part of your
application, please ensure your provide a one page covering letter to
include relevant contact address, telephone, fax and e-mail details. In
addition you are required to provide pre-qualification information as
requested below.
Applicants should provide details of any County Court judgements or other
prosecutions within the previous 3 years. Consortia may be required to
form a legal entity prior to any award. Thames Water Utilities Limited
reserves the right to award no contract(s) as a result of this award
procedure.
III.2.2) Economic and financial capacity: Thames Water operates a risk
management approach with regard to the Economic and Financial capacity of
its Suppliers and where appropriate will seek further information (either
directly from the Supplier (or via an externally recognised information
provider) on the applicants Economic & Financial capacity. Applicants are
advised that Thames Water currently operates an internal risk management
approach with regard to the Economic and Financial capacity of its
successful suppliers and where appropriate will seek further information
over the duration of the contract period, (either directly from the
supplier or via an externally recognised economic and financial
information provider, for example "Dun & Bradstreet") as to the supplier's
on-going Economic & Financial capacity post contract award.
Information gathered over the duration of the contract period may be
utilised as part of Thames Water internal risk management process.
Applicants must supply audited accounts for the last 2 years, Where this
is not possible (new organisation/joint venture, applicants must provide
business plan information covering a 2 year period.
Minimum turnover requirements will be considered in relation to the volume
of work applied for.
III.2.3) Technical capacity: Information and formalities necessary for
evaluating if requirements are met: Confirm which for the types (A or B)
of B100 your company is applying to supply.
1. Your organisation: Please provide the address of your registered
office, and details of the UK locations you operate from, together with
the named person responsible for this application. Please state whether
your company is part of a group or is affiliated in any way with other
companies. If so, please provide details of the group company structure or
other company relationships. Alternatively provide details if you propose
to develop a new partnership with another company to deliver this service;
2. Provide an organogram of the part of your company applying for this
supply contract;
3. Provide an overview of your business as follows:
Describe your business model i.e. growth of first generation feedstocks /
supply of second generation feedstocks, biofuel production from
bought-infeedstocks, distributor of biofuels produced by others.
Describe your short-term (1-2 years) and long-term (2 years - 5 years)
business strategy.
Give an overview of your customer portfolio, including sector type and
approximate volumes supplied.
4. Experience: Provide reference details of at least two previous B100
supply contracts undertaken in the last two years for contracts of similar
size to Thames Water's. Include the following:
Start and end dates.
Volumes shipped per week.
Specifications supplied.
Distribution methods.
Pricing model used.
Confirmation that Thames Water may contact the referees.
5. Operational Information:
(a) State the types of feedstocks used and the source country for each;
(b) State the types of waste oils & fats used as feedstocks and level of
preprocessing your company undertakes;
(c) State whether your company can blend a variety of feedstocks and
whether this is an in-house or outsourced activity;
(d) State the location of your operations and the delivery route and modes
of transport that would be used for this contract including details of all
supply chains involved in:
— growth and production of crops or re-cycled products such as used
cooking oil or tallow,
— transport of these crops or re-cycled products to the biodiesel
processing plant,
— biodiesel production and storage,
— transport of biodiesel to Thames Water's site at Beckton.
These details should include all aspects of the relevant supply chains,
from methods of clearing virgin ground ready for crop growth; cultivation,
fertilisation and harvesting, through to storage, transport, shipping and
any necessary crushing and / or pre-treatment. This should also include
the means of ensuring ethical and fair-trade practices and welfare of all
people involved in the supply chain, in all countries involved outside of
the EU.
(e) State your current production capacity in litres/year;
(f) State whether Thames Water's requirements would be delivered through
existing infrastructure or whether additional capacity would be required
to meet the Thames Water demand. Give an overview of how you would gear up
for this volume and the timeframes involved;
(g) State your site storage capacity (both on own premises or third
party's) near Thames Estuary. Confirm if your storage tanks are heated and
if so to what temperature;
(h) If relevant please explain how your company or a third party utilises
the glycerine by-product of Biofuel production;
(i) Provide details of the testing regime used and provide example testing
certificates. Confirm if this is carried out in-house or by a third party.
Explain how this fits in with your TQM;
(j) Provide details of your delivery fleet (land, sea & river) and of
external provider if appropriate;
7. Give an overview of pricing mechanisms you work with e.g. £/litre, £
per Mega joule.
8. Provide and overview of the pricing methodologies used in the purchase
of Biodiesel.
9. Explain your approach to purchasing of raw materials / feedstocks / end
product for distribution and how you ensure continuity of supply.
10. Give details of any industry standards to which your organisation
adheres, and provide details of any industry associations or trade
organisations of which your organisation is a member (do not provide any
certification at this stage).
11. Provide details of any quality assurance system you are accredited to
(do notprovide certification at this stage).
12. Health & Safety: Please provide brief details of any health and safety
policy which you have in place and how your policy will be implemented
with relation to this work; H&S manuals should not be forwarded with this
application.
13. Environmental issues: Please provide details of any Environmental
Policy you have in place. Provide details of any environmental
convictions/prosecutions your company has incurred/been involved in.
Please note Environmental Policy manuals should not be included with this
application; further details will be requested from applicants as
required.
14. Confirm your capability to accept orders via telephone, fax, e-mail
and the internet.
15. Confirm your capability to accept payment via a range of methods
including individual and consolidated invoicing and purchasing cards.

Negotiation will then take place with one of more successful tenderers to
secure the most economically advantageous offer to TWUL.
Applicants should note that this process might require references to be
provided and verified, attendances at meetings, talks and presentations at
no cost to TWUL.
Any agreement resulting from this contract notice may be modified to
include further similar requirements at any site under the management of
Thames Water Utilities Limited or its associated companies (subsidiaries,
sister, parent company (and Group of Companies) within the EU, seven years
from the agreement date.
This contract notice does not preclude Thames Water Utilities Limited or
it's associated companies (subsidiaries, sister, parent companies etc)
from issuing other contract notices for specific requirements from time to
time.
There is no application form available for completion - companies are
required to respond directly to this Notice. Applications should submit 5
x CD Roms of their responses to the Procurement Support Centre. Companies
who qualify for inclusion on the Tender List may be required to
demonstrate their services in practical trials or presentations at no cost
to Thames Water Utilities Limited. Applicants who fail to supply all of
the information requested in response to this Notice may risk elimination.
Applications must be clear and concise and contain all the information
requested in this notice. The format of supplier's responses must be such
that each point is restated and immediately followed by the supplier's
answer. Contracts will be under UK Law. There will be no further call for
competition.

VI.4) PROCEDURES FOR APPEAL
VI.4.1) Body responsible for appeal procedures: See Section VI.4.2.
VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: This authority will incorporate a minimum 10 calendar day
standstill period at the point information on the award of the contract is
communicated to tenderers. This period allows unsuccessful tenderers to
seek further debriefing from the contracting authority before the contract
is entered into. Applicants have two working days from notification of the
award decision to request additional debriefing and that information has
to be provided a minimum of 3 working days before expiry of the standstill
period. Such additional information should be requested from the address
in section 1.1.
If an appeal regarding the award of a contract has not been successfully
resolved the utilities contracts Regulations (SI 2005 No 6) provide for
aggrieved parties who have been harmed or are at risk of harm by a breach
of the rules to take action in the High Court (England, Wales and Northern
Ireland). Any such action must be brought promptly (generally within 3
months).
Where a contract has not been entered into the court may order the
settling aside of the award decision or order the authority to amend any
document and may award damages. If the contract has been entered into the
court may only award damages.
