IV.1) TYPE OF PROCEDURE
IV.1.1) Type of procedure: Accelerated restricted.
Justification for the choice of accelerated procedure: Lambeth College
must have the contracts in place in time for the start of the new academic
year, starting in September.
IV.1.2) Limitations on the number of operators who will be invited to
tender or to participate: Envisaged number of operators 15
Objective criteria for choosing the limited number of candidates: As set
out in the pre-qualification questionnaire in line with Regulations 16(7),
16(8), 23, 24, 25 and 26 of UK Statutory Instrument 2006/5.

SECTION VI: COMPLEMENTARY INFORMATION
VI.1) THIS IS A RECURRENT PROCUREMENT: No.
VI.2) CONTRACT RELATED TO A PROJECT AND/OR PROGRAMME FINANCED BY EU
FUNDS: No.
VI.3) ADDITIONAL INFORMATION: The envisaged number of operators who will
be invited to tender or to participate (point IV.1.2) is 15 and this is
split into 5 operators for each lot. This contract envisages that Lambeth
College may, under these arrangements: seek temporary staff; employ
permanent staff who have been temporary staff; and may sometimes seek
permanent staff. Lambeth College reserves the right to seek staff
(temporary or permanent) outside of these arrangements. Lambeth College
will not guarantee that any of the candidates put forward will be engaged.
All dates and times other than the date to respond to the
pre-qualification questionnaire ( ) are provisional only. Lambeth College
is not liable for any costs incurred by those expressing interest in
tendering for this contract. The college reserves the right not to award a
contract or to award contract(s) for part or parts of the service only.
The Freedom of information Act (FOI) came fully into force in 2005. If any
applicant considers that any information supplied by them is either
commercially sensitive or confidential in nature, this should be
highlighted and the reasons for its sensitivity as well as the duration of
such sensitivities specified. In such cases the relevant material will in
response to FOI requests, be examined in the light of exemptions provided
for in the FOI. In relation to point IV.1.2, the envisaged number of
operators are an approximation only. The college may require bidders to
meet certain security clearance requirements to be outlined in the tender
documentation. The college reserves the right to permit changes to
consortium membership. The college reserves the right to change without
notice the procedure for awarding the contract, to reject all or any bids
for the contract, to terminate discussions with any or all interested
tenders and/or to stop the process and not award a contract at any time
without any liability on its part. Nothing in this OJEU or procurement
competition shall generate any contractual obligations prior to any
signature of final contracts.
VI.4) PROCEDURES FOR APPEAL
VI.4.1) Body responsible for appeal procedures: Any appeals under this
process should be addressed to the contact in point I.1.
VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: A bidder which has any concerns about the process should
raise them as soon as possible in the first instance to the contact in
point I.1. Bidders have various rights to information including under
Regulation 32 of The Public Contracts Regulations 2006 SI 2006/05 and
under the Freedom of Information Act 2000. A dissatisfied economic
operator can enforce against legal breaches under Regulation 47 before the
High Court in England and Wales.
