advertises the awarding by tie Limited of the Contracts for the supply and
long term maintenance of a fleet of vehicles for the Edinburgh Tram
Network. This involves the design, manufacture, supply and maintenance of
trams and associated equipment in respect of the Edinburgh Tram Network. A

SECTION VI: COMPLEMENTARY INFORMATION
VI.1) CONTRACT RELATED TO A PROJECT AND/OR PROGRAMME FINANCED BY
COMMUNITY FUNDS: No.
VI.2) ADDITIONAL INFORMATION: The total value of the Tramco contracts is
£67 100 000 as detailed in section II.2.1. The final contract price for
the Tram Supply Contract is £55 800 000. The value calculated for the Tram
Maintenance Contract comprises of a £2 300 000 mobilisation payment and
then approximately £1 800 000 per annum for an initial 5 years (subject to
currency fluctuation, indexation and volume flexing). The Client has the
right to terminate the Tram Maintenance Contract after three years from
service commencement subject to a 6 month notice and at any time after 5
years following service commencement. The contract has a 30 year term.
VI.3) PROCEDURES FOR APPEAL:
VI.3.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: Tie Limited communicated the intention to award the
contract to unsuccessful tenderers, the minimum 10 calendar day standstill
period then elapsed prior to contract signature. This period allowed for
unsuccessful economic operators to seek further debriefing from tie
Limited before the contract was entered into. If an appeal regarding the
award of contracts has not been successfully resolved, the Public
Contracts (Scotland) Regulations 2006 (SSI 2006 N°1) provide for aggrieved
parties who have been harmed or are at the risk of harm by any infraction,
to take action in the Sheriff Court or Court of Session.
