VI.1) THIS IS A RECURRENT PROCUREMENT: No.
VI.2) CONTRACT RELATED TO A PROJECT AND/OR PROGRAMME FINANCED BY EU
FUNDS: No.
VI.3) ADDITIONAL INFORMATION: The successful contractor will be required
as a condition of contract to observe as far as possible the Code of
Practice for the Elimination of Racial Discrimination and the Promotion of
Equality of Opportunity in Employment issued by the (UK) Commission for
Racial Equality. The pre-qualification questionnaire is only available
from the address quoted in Annex A. The authority has an Environmental
Policy and is committed to using the most environmentally and socially
responsible goods and services consistent with good performance and
encourages all its contractors and suppliers to do the same. The London
Borough of Camden undertakes to use its best endeavours to hold
confidential any information provided in the proposal submitted, subject
to the Council's obligation under law, including the Freedom of
Information Act 2000. Applications will only be accepted upon our
questionnaires, which can be obtained from the address detailed in Annex
A. The deadline for receipt of tenders shall be deemed to be met upon the
receipt of a questionnaire being received by the Head of Legal Services at
the London Borough of Camden by hard copy delivery (not by e-mail) to
their offices as detailed in Annex A on or before the deadline noted
herein. Completed copies of the questionnaires should also be forwarded to
Hymans Robertson via e-mail or hard copy delivery to their offices as
detailed in Annex A the day after the deadline noted herein. Although this
is an ongoing contract, it will be subject to the review and termination
provisions set out in the final contract. The contract will be reviewed
every 5 years, or more frequently if required.
VI.4) PROCEDURES FOR APPEAL
VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: This authority will incorporate a minimum 10 calendar day
standstill period at the point the information on the award of the
contract is communicated to the tenderers. This period allows unsuccessful
tenderers to seek further debriefing from the contracting authority before
the contract is entered into. Applicants have two working days from
notification of the award decision to request additional debriefing and
that information has to be provided a minimum of 3 working days before
expiry of the standstill period. Such additional information should be
requested from the address in Annex A. If an appeal regarding the award of
the contract has not been successfully resolved the (for Public Sector)
Public Contracts Regulations 2006 (SI 2006 No5) provide for the aggrieved
parties who have been harmed or are at risk of harm by a breach of the
rules to take action in the High Court (England, Wales and Northern
Ireland). Any such action must be brought promptly (generally within 3
months). Where a contract has not been entered into the court may order
the settling aside of the award decision or order the authority to amend
any document and may award damages. If the contract has been entered into
the court may only award damages.
