SECTION II: OBJECT OF THE QUALIFICATION SYSTEM
II.1) TITLE ATTRIBUTED TO THE QUALIFICATION SYSTEM BY THE CONTRACTING
ENTITY: 584 Construction, Operational & Service Register.
II.2) TYPE OF CONTRACT: Works.
II.3) DESCRIPTION OF THE WORKS, SERVICES OR GOODS TO BE PROCURED THROUGH
THE QUALIFICATION SYSTEM: (Please note that Suppliers already registered
do NOT have to re-apply, unless they wish to apply for a new lot).
Please note that Lots 1, 3, 4, 6, 7, 8, 9, 10, 11, 12, 24 and 25 are
likely to have limited further competition as they are likely to be
superseded by a new Qualification System, the Notice for which was
published on 24.7.2008 reference 190811-2008-EN. Lots 2, 5, 19, 20, 21,
22, 27 and 28 will continue. Lot 29 is a new Lot.
TWUL utilises the "Performance Partnering" methodology within a number of
the following lots held within the register. For the avoidance of doubt
Performance Partnering for the purposes of this Qualification System has
the following meaning:
Long term commercial arrangements,
Contractors/Consultants working in a fully collaborative way with TWUL to
achieve full supply chain management and supplier development,
Complete transparency of all contractor/consultant costs, overheads and
profit,
Open access by TWUL to all contractor/consultant activities, processes and
procedures in order to seek out and eliminate waste and inefficiency.
Continuous improvement in functionality and cost against stretch targets.
A fixed profit to the contractor/consultant (which may/may not include an
gainshare/painshare arrangement).
A rigorous enforced performance regime which provides continuity of work
for good performers and reduced work, followed by substitution for poor
performance.
In the Lot descriptions, agreements - means commercial arrangements under
which individual contracts may be placed, Performance Partnering
Agreements may be put in place with a number of contractor/consultants to
enable the exercise of continuity and substitution over the agreement
duration. TWUL will decide by which of several possible delivery routes a
particular project is delivered.
Lot no 1.
Process agreements: - Construction works on sewage treatment works, water
treatment works, pumping stations, reservoirs and the like. Performance
Partnering. Including but not limited to contracts up to £ 15m. Agreements
and contracts will be formed by competition from within this register.
Agreements may range in size, indicatively from £ 2m to £ 50m per year.
Lot no 2.
Process Contracts. Construction works on sewage treatment works, water
treatment works, pumping stations, reservoirs and the like. Agreements and
contracts will be formed by competition from within this register.
Individual contracts may be of any value.
Lot no 3.
Small process contracts. Construction works on sewage treatment works,
water treatment works, pumping stations, reservoirs and the like.
Agreements and contracts will be formed by competition from within this
register. Contracts may be up to, but not limited to £1m.
Lot no 4.
Network agreements. Construction works on pumping stations, water mains,
sewers, pipelines, tunnels, reservoirs and the like. Performance
Partnering. Including but not limited to contracts up to £7m. Agreements
and contracts will be formed by competition from within this register.
Agreements may range in size, indicatively from £2m to £60m per year.
Lot no 5.
Network contracts. Construction works on pumping stations, water mains,
sewers, pipelines, tunnels, reservoirs and the like. Agreements and
contracts will be formed by competition from within this register.
Individual contracts may be of any value.
Lot no 6.
Water network upgrade. Upgrade of all or part of the water distribution
network within a district metering area, and the like. Performance
Partnering. Including but not limited to contracts up to £7m. Agreements
and contracts will be formed by competition from within this register.
Agreements may range in size, indicatively from £2m to £50m per year.
Lot no 7.
Small network contracts. Constructions works on pumping stations, water
mains, sewers, pipelines, tunnels, reservoirs, and the like. Some
agreements may require emergency (24 hours 7 days a week) response for
pipeline/sewer repair/collapse. Agreements and contracts will be formed by
competition from within this register. Contracts may be up to, but not
limited to £1m.
Lot no 8.
Clean water network repair and maintenance. Repair and maintenance works
on clean water network assets and the like. Performance Partnering. Some
agreements may require emergency (24 hours 7 days a week) response.
Agreements may range in size, indicatively from £2m to £60m per year.
Lot no 9.
New mains and connections. Connections of new customers to the water
network where a significant degree of new main laying, diversion or
reinforcement is required. Agreements and contracts will be formed by
competition/negotiation from within this register. Indicative annual
expenditure £9m.
Lot no 10.
Standard new connections. Connections of new customers to the water
network including small diversions and reinforcement. Performance
Partnering. Agreements will be formed by competition from within this
register. Agreements may range in size, indicatively from £2m to £10m per
year.
Lot no 11.
Customer side leakage. Surveying, issue resolution, repair or relay of the
customer's supply pipe, and the like. Performance Partnering. Agreements
will be formed by competition from within this register. Indicative annual
expenditure £5m split between a number of agreements.
Lot no 12.
Revenue metering. Surveying, installation or exchange of domestic, and
commercial meters and the like. Performance Partnering. Agreements will be
formed by competition within this register. Agreements may range in size,
indicatively from £2m to £10m per year.
Lot no 19.
Engineering consultancy. Engineering consultancy to support one or more of
other lots or the like. Some agreements will be Performance Partnering.
Agreements and contracts will be formed by competition from within this
register. Indicative annual expenditure £30m split between a number of
agreements.
Lot no 20.
Leak detection consultancy. Leak detection and pressure management
consultancy to support one or more of the other Lots or the like. Some
agreements will be Performance Partnering. Agreements and contracts will
be formed by competition from this register. Indicative annual expenditure
£10m split between a number of agreements.
Lot no 21.
Leak detection services. Field work involving open sounding, leak
correlation, noise logging, step testing and the like. Performance
Partnering. Agreements will be formed by competition from within this
register. Indicative annual expenditure £15m split between a number of
agreements.
Lot no 22.
Quantity Surveying Services. Estimating, cost management, and cost and
planning services to support other Lots and the like, Performance
Partnering. Agreements will be formed by competition from within this
register. Indicative annual expenditure £3m per year split between a
number of agreements.
Lot no 24.
Sewerage network operations. Sewer blockage clearance, manhole cover
replacement and minor sewer repairs, maintenance of sewer ancillaries,
flooding incident response and clear up, rodent control, and the like.
Some agreements may require emergency (24 hours 7 days a week) response.
Agreements will be formed by competition from within this register.
Indicative annual expenditure £20m per year split between a number of
agreements.
Lot no 25.
Sewer Cleaning. Sewer cleaning and de-silting service, and similar
services. Agreements and contracts will be formed by competition from
within this register. Indicative annual expenditure £2m per year split
between a number of agreements.
Lot no 27.
Environmental consultancy. Environmental consultancy to support one or
more lots and similar services. Agreements and contracts will be formed by
competition from within this register.
Lot no 28.
Town planning consultancy. Town planning consultancy to support one or
more of the other Lots or similar services. Agreements and contracts will
be formed by competition from within this register.
Lot no 29.
Large pipe and fittings supply contracts. Supply of pipe and fittings for
water mains, sewers, pipelines and the like. Individual contracts may be
any size, indicatively greater than £250k. Applications are invited for
any or all of the Lots on the Register.

II.5) CONTRACTS COVERED BY THIS QUALIFICATION SYSTEM ARE COVERED BY THE
GOVERNMENT PROCUREMENT AGREEMENT (GPA): No.
SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION
III.1) CONDITIONS FOR PARTICIPATION
III.1.1) Qualification for the system Conditions to be fulfilled by
economic operators in view of their qualification: 1) Advise which lots
your company is applying for
2) Your organisation: please provide the address of your registered office
and details of the Locations which you operate from and would utilise to
provide works/services for the lots applied for;
3) Please state whether your Company is part of a group or is affiliated
in any way with other companies, if so please provide details of the Group
Company Structure or other company relationships.
4) Applicants should provide details of any High Court or County Court
judgements, or similar European judgements decrees or awards, or other
prosecutions within the previous 3 years from the publication date of this
notice.
5) Applicants must supply audited accounts for the last 3 years. Where
this is not possible (new organisation/joint venture), applicants must
provide business plan information covering a similar period.
6) Briefly describe your organisations experience (This should include
Technical, Project management, Planning & Customer Service) relevant to
the Lots applied for.
Methods according to which each of those conditions will be verified: 1)
Initial pre-qualification for inclusion on the register for the Lot's
applied for, based on response to conditions 1 to 6.
2) Where the number of suppliers on a register for a Lot exceeds 6,
further pre-qualification for tendering opportunities may occur. Further
pre-qualification for tendering opportunities within the specific Lot.
Criteria will be based on Commercial, Technical and Other criteria (for
example, Site Visits, Presentations, References, Corporate Social
Responsibility and Sustainable Procurement Policies)
3) Invitation to Tender (ITT) will be sent to Suppliers who have
successfully passed stage 1 & 2 above, the ITT will have the criteria for
the tender assessment stated within the ITT documentation.
4) Criteria for rejection of economic operators in addition to 1 to 3
above include Clause 26 Statutory Instrument 2006 No. 6 "criteria for
rejection of economic operators".
SECTION IV: PROCEDURE
IV.1) AWARD CRITERIA
IV.1.1) Award criteria: The most economically advantageous tender in
terms of the criteria stated in the specifications, in the invitation to
tender or to negotiate.
IV.1.2) An electronic auction will be used: No.
IV.2) ADMINISTRATIVE INFORMATION
IV.2.1) File reference number attributed by the contracting authority:

IV.2.2) Duration of the qualification system: Indefinite duration.
IV.2.3) Renewal of the qualification system: Yes.
Formalities necessary for evaluating if requirements are met: Following
qualification, applicants will be added to the register, applicants will
be able to join the register at any time. An annual call for competition
for this register will be published in the Official Journal Of the
European Union.
SECTION VI: COMPLEMENTARY INFORMATION
VI.1) ONE OR MORE CONTRACTS COVERED BY THE QUALIFICATION SYSTEM ARE
RELATED TO A PROJECT AND/OR PROGRAMME FINANCED BY COMMUNITY FUNDS: No.
VI.2) ADDITIONAL INFORMATION: Applicants will be advised of their success
or failure in accordance with UK Statutory Instrument 2006 No 6 section
25, para 11.
Applicants should note that this process might require references to be
provided and verified, attendances at meetings, talks and presentations at
no cost to TWUL.
Any agreement resulting from this qualification system notice may be
modified to include further similar requirements at any site under the
management of Thames Water Utilities Limited or its associated companies
(subsidiaries, sister, parent company) within the EU, five years from the
agreement date.
This contract notice does not preclude Thames Water Utilities Limited or
it's associated companies (subsidiaries, sister, parent companies etc)
from issuing other contract notices for specific requirements from time to
time.
There is no application form available for completion - companies are
required to respond directly to this Notice. Responses to the Notice
should consist of a maximum of 20 pages (40 sides) of A4 paper. Accounts
and copies of certificates should not be submitted in paper form but
should be included on the CD only. Applicants should submit one hard copy
in a flat or spiral binder and one electronic version in a single file in
Adobe Acrobat pdf format on CD. Storage is limited, and applicants are
requested not to use lever arch folders or other bulky bindings, or to
submit more than one copy. Applicants should not include non-requested
sales literature with their applications. Packages weighing more than
10kgs. cannot be accepted. Companies who qualify for inclusion on the
Tender List may be required to demonstrate their services in practical
trials or presentations at no cost to Thames Water Utilities Limited.
Applicants who fail to supply all of the information requested in response
to this Notice may risk elimination. Candidates who cannot fully meet all
criteria may risk elimination. The contents of this Notice are sufficient
for submissions of pre-qualification data; all other communications are
discouraged. Applications must be clear and concise and contain all the
information requested in this notice. The format of supplier's responses
must be such that each point is restated and immediately followed by the
supplier's answer. Contracts will be under UK Law.

VI.3) PROCEDURES FOR APPEAL
VI.3.1) Body responsible for appeal procedures: See Section VI.4.2.
VI.3.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: This authority will incorporate a minimum 10 calendar day
standstill period at the point information on the award of the contract is
communicated to tenderers. This period allows unsuccessful tenderers to
seek further debriefing from the contracting authority before the contract
is entered into. Applicants have 2 working days from notification of the
award decision to request additional debriefing and that information has
to be provided a minimum of 3 working days before expiry of the standstill
period. Such additional information should be requested from the address
in section 1.1.
If an appeal regarding the award of a contract has not been successfully
resolved the utilities contracts Regulations (SI 2005 No6) provide for
aggrieved parties who have been harmed or are at risk of harm by a breach
of the rules to take action in the High Court (England, Wales and Northern
Ireland). Any such action must be brought promptly (generally within 3
months). Where a contract has not been entered into the court may order
the settling aside of the award decision or order the authority to amend
any document and may award damages. If the contract has been entered into
the court may only award damages.
