II.1) DESCRIPTION

Main site or location of works: The Stan Ball Centre, Bloxwich East, West
Midlands, UK, WS3 3BW.

II.1.3) The notice involves: A public contract.
II.1.5) Short description of the contract or purchase(s): To construct a
community building on a cleared site, primarily for people aged over
fifty, with some specialist day centre provision for older people with
health conditions, including those who have had strokes. The centre is
also to accommodate a learning disabilities project for older clients to
be run by Walsall Integrated Learning Disabilities Service. The
development has been planned to ensure that it will be sustainable in the
long term and deliver sustainable regeneration outcomes to the local
community. It is also proposed to construct a separate two storey block of
office accommodation on the same site with an area of approximately 1 000
m² which will be occupied by the local PCT. The total site area is
approximately 0,64 hectares and the works will include inter - alia
landscaping, creating parking areas and access improvements.

III.1) CONDITIONS RELATING TO THE CONTRACT

be required to complete the contracting authority's Pre -Qualification
Questionnaire (PQQ) which is only avaliable from the person named in Annex
A.III and must be returned by electronic mail and in hard copy format to
the same address and contact point by the date stipulated in Section
IV3.4.
III.2.2) Economic and financial capacity: Information and formalities
necessary for evaluating if requirements are met: The information and
documentation required is set out in the PQQ which can only be obtained
via electronic mail from the person named in Annex A.III and must be
returned by electronic mail and in hard copy format to the same address
and contact point by the date stipulated in Section IV.3.4. The
contracting authority need not consider any request to participate unless
it is accompanied by a completed PQQ.
Minimum level(s) of standards possibly required: These are set out in the
PQQ.

SECTION VI: COMPLEMENTARY INFORMATION
VI.1) THIS IS A RECURRENT PROCUREMENT: No.
VI.2) CONTRACT RELATED TO A PROJECT AND/OR PROGRAMME FINANCED BY EU
FUNDS: No.
VI.3) ADDITIONAL INFORMATION: The contracting authority reserves the
right not to award a contract or to award a contract for part or parts of
the advertised works. The contracting authority reserves the right to
award GBP 30 000 of the aggregate value of the consideration it expects to
be payable under all the contracts to be entered into to fulfil the single
requirement for the carrying out of the work or works in accordance with
the provisions of Article 9(5) of Directive 2004/18/EC. Expressions of
Interest will be accepted only by electronic mail to the email address
stated in Annex A.III. The body text to the email must specify the email
address to which the PQQ must be sent. The body text of the email must
contain the organisation's name, address, telephone number and the name of
the person within the organisation. Organisations who submit an Expression
of Interest in compliance with these requirements will be provided with a
PQQ. Expressions of interest not submitted in compliance with these
requirements may be rejected. The completed PQQ and all supporting
documents must be returned by electronic mail and by post to the address
stated in Annex A.III within the time limit specified in Section IV.3.4 of
this Notice. Completed PQQs received after the deadline may not be
considered. Under this procurement the contractor is required to
participate actively in the economic and social regeneration of the
locality of and surrounding the place of delivery for the procurement.
Accordingly contract performance may relate in particular to social and
environmental considerations.
VI.4) PROCEDURES FOR APPEAL
VI.4.1) Body responsible for appeal procedures: See V1.4.2 below.
VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: The contracting authority will incorporate a minimum 10
calender day standstill period at the point information on the award of
the contract is communicated to tenderers. This period allows unsuccessful
tenderers to seek further debriefing from the contracting authority before
the contract is entered into. Applicants have 2 working days from the
notification of the award decision to request additional debriefing and
that information has to be provided a minimum of 3 working days before the
expiry of the standstill point. Such additional information should be
required from the address in Annex A.I. If an appeal regarding the award
of a contract has not been successfully resolved the Public Contracts
Regulations 2006 (SI 2006 No 5) provide for the aggrieved parties who have
been harmed or are at risk of harm by a breach of the rules to take action
to the High Court (England, Wales and Northern Ireland). Any such action
must be brought promptly (generally within 3 months). Where a contract has
not been entered into, the Court may consider the setting aside of the
award decision or order the contracting authority to amend any document
and may award damages. If the contract has been entered into the Court may
only award damages.
