II.1) DESCRIPTION

II.1.5) Short description of the contract or purchase(s): Expressions of
interest are sought for the supply of a replacement to the clinical
assessment and hearing instrument measurement system. This will be a
computer controlled integrated system and requires 15 clinical units. The
system will have the following functionality and capability:
1) Integration with the current Patient Management System (Practice
Navigator).
2) Audiometry function in accordance with relevant standards.
3) Hearing instrument analyser in accordance with relevant standards
4) Probe microphone system enabling real ear measurements and 2cc coupler
measurements of hearing aid performance in accordance with relevant
standards.

III.1) CONDITIONS RELATING TO THE CONTRACT
III.1.1) Deposits and guarantees required: Tenderers may be required to
provide a guarantee from its ultimate holding company and collateral
warranties to funders and other participants, and will be required to
provide evidence of professional indemnity insurance for at least 5
million GBP for each and every claim.

VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: This Trust will incorporate a minimum 10 calendar day
standstill period at the point information on the award of the contract is
communicated to tenderers. This period allows unsuccessful tenderers to
seek further debriefing from the contracting authority before the contract
is entered into. Applicants have 2 working days from notification of the
award decision to request additional debriefing and that information has
to be provided a minimum of 3 working days before expiry of the standstill
period. Such additional information should be requested from the address
in section 1.1.
If an appeal regarding the award of a contract has not been successfully
resolved the (for Public Sector) Public Contracts Regulations 2006 (SI
2006 No 5) (for Utilities) utilities contracts Regulations (SI 2005 No.6)
(delete where appropriate) provide for aggrieved parties who have been
harmed or are at risk of harm by a breach of the rules to take action in
the High Court (England, Wales and Northern Ireland). Any such action must
be brought promptly (generally within 3 months). Where a contract has not
been entered into the court may order the settling aside of the award
decision or order the authority to amend any document and may award
damages. If the contract has been entered into the court may only award
damages.
